Sr. Consultant, Litigation Technology

Summary: Leads a team responsible for providing support and guidance on the acquisition, assessment and delivery of information and documents in support of corporate discovery and/or large regulatory inquiries. Directs the development and implementation of processes, procedures and methods intended to ensure the efficient and effective handling of all hosted review projects. Provides consultation on projects regarding electronic communication, IT systems policies, records retention and discovery risks.

Reporting Relationships: Reports to Managing Counsel. Up to three Litigation Technology direct reports.

Core Duties and Responsibilities:

Applies expertise in the use of existing review tools and platforms; develops expertise in new technologies and can train and guide team members in developing proficiency in the tools and platforms. Executes on deep subject-matter expertise to provide recommendations and guidance on the best approach for identifying, collecting, processing, reviewing and producing data. Implements standardized “best in class” workflows to manage discovery from preservation to final resolution. Manages large and diverse collections of structured and unstructured data (e.g. e-mails, images, and native files in combination with databases). Responsible for building, maintaining, and troubleshooting e-discovery databases, culling and analyzing data, employing Early Case Assessment and/or Advanced Analytics when appropriate, and overseeing the loading of new or updated data, images, and native files for legal team review. Educates and consults with legal team on options for technology assisted review/predicative coding and manages such projects when implemented. Supports overall hosted review database requirements and trains team to create and edit views, layouts, choices, and/or fields. Leads and/or participates in all aspects of production, from initial communication with legal teams to final distribution of deliverables, management of post-processing collections and generation of privilege logs. Provides technical expertise on forms of production, analyzing ESI, processing ESI and maintaining chain of custody. Evaluates and analyzes data to support litigation matters and case strategy, including crafting and/or refining key word searches. Applies knowledge of the Federal Rules of Civil Procedure and leads team of non-attorneys to understand how to perform their work under the guidance of attorneys and legal requirements. In coordination with DMU leadership, oversees all vendor activity with clearly defined expectations and monitoring for conformance, including coordinating eDiscovery vendors, managing performance, negotiating contracts for services, and selecting appropriate tools and services for eDiscovery projects. Assists in the selection and oversight of contract review teams. Strong emphasis on quality control checking of all work, including data from vendors and third parties and building quality into all aspects of team work product. Demonstrates deep understanding of and ability to manage the legal holds process, as necessary, including an understanding of technology, internal processes and best practices for governance. Harmonizes discovery processes and information governance approaches. Leads projects and assists with the identification and archiving of old case data. Provides eDiscovery application support within the department and to broader legal teams. Assists users with problems and questions, while guiding the litigation team through the entire EDRM process. Trains attorneys and paralegals in the effective use of all e-discovery technology software. Tracks all case-related activity utilizing project management tools and matter management/data management systems. In consultation with DMU legal counsel, consults on enterprise-wide technology initiatives regarding electronic communications, IT systems policies, records retention and discovery risks. Serves as back-up and overflow for Discovery Project Manager, as needed. Leads or participates in special projects and other duties, as needed.

Typical Skills and Experiences:

Education: Bachelor’s Degree; J.D. or Master’s Degree preferred

License/Certification/Designation: Obtaining certification as an E-Discovery Specialist through the Association of Certified E-Discovery Specialists may be required within the first 12 months of employment.

Experience: Five or more years’ experience within law, technology, consulting or project management; one to three years of people leadership experience. Corporate legal department, law firm, or litigation processing/hosting environment strongly preferred.

Knowledge, Abilities and Skills: Ability to effectively collaborate with internal and external stakeholders to identify best workflows for eDiscovery projects. Subject matter expertise with technology/computer assisted review/advanced analytics and technology assisted review. Subject matter expertise with all phases of EDRM model and e-discovery principals. Proficiency with various tools, systems and software used to support discovery/litigation within the DMU, LED, Digital Forensics Investigations (DFI) or elsewhere in the company (e.g. Nuix, Relativity, Axcelerate, Legal Hold Pro, O365, Microsoft Office, SourceOne, TeamConnect, Passport, iManage, etc.). Highly organized and detail oriented, but also adaptive and able to rise above the detail to see broader implications and anticipate both short and long-term consequences and/or cause and effect of decision-making. Highly collaborative, credible, engaging and authoritative with an ability to build strong working relationships at all levels across the company and with external partners. Ability to work with ambiguity in a highly matrixed organization. Demonstrated comfort navigating through change and leading others through change. Passion for building or enhancing process. Strong time-management skills. Self-starter/Pro-active. Exemplary communication skills. Willing to question assumptions and propose alternative solutions, including justifying recommendations and rationally handling objections and counter-proposals. Significant understanding of the litigation lifecycle and e-discovery project management experience preferred.
